Terms of Service

These Terms of Service (“Terms”) govern your use of Señor Bistec, an AI nutrition coaching bot that operates on the Telegram messaging platform, provided by Ilia Lapin (autónomo / self-employed), NIF Z1780472R, Plaza Equipo Cronica 5, PTA 30A, 46023 Valencia, Spain (“we”, “us”, “the Provider”).

By using Señor Bistec, you (“the User”) agree to these Terms. If you do not agree, please stop using the service.

1. Service description

Señor Bistec is an AI-powered nutrition coaching bot that operates within Telegram. The service includes:

• Meal analysis: You send food photos, text descriptions, or voice messages, and the bot uses AI to estimate calories and macronutrients (protein, carbohydrates, fat).
• Progress tracking: The bot records your daily intake, body measurements, water consumption, and tracks your progress over time.
• Personalised coaching: Based on your profile (height, weight, age, sex, goal, activity level), the bot provides personalised nutritional guidance and feedback.
• Gamification: Achievements, streaks, and other motivational features to keep you engaged.
• Reminders: Configurable meal and water reminders.

2. Pricing and payment

If you do not cancel before the free trial ends, your subscription will automatically begin and you will be charged for the first month. We will notify you before the trial expires.

3. Free trial

New users receive a 14-day free trial with full access to all features. The trial begins when you activate your account in the bot. No payment information is required to start the trial.

If you do not wish to continue after the trial, simply do not subscribe. Your account data will be retained for 2 years in case you decide to return, after which it will be deleted (see our Privacy Policy).

4. Referral programme

You may invite others to try Señor Bistec using your personal referral code. When a new user signs up with your code:

• You receive 14 additional free days of service.
• The referred user also receives 14 additional free days (on top of their standard trial).

Referral bonuses are applied automatically. We reserve the right to modify or discontinue the referral programme at any time, with prior notice.

5. Cancellation

You may cancel your subscription at any time by sending the /unsubscribe command in the bot. Cancellation takes effect at the end of the current billing period — you will retain access until the period you have already paid for expires.

No refund is given for partial months already paid, except where required by applicable consumer protection law or in the case of exercising your right of withdrawal (see Section 10).

6. AI disclaimer

Specifically:

• Calorie and macronutrient values generated by the AI are estimates only. Actual nutritional content may vary based on portion size, preparation method, ingredients, and other factors.
• The bot’s responses should not be used as a substitute for professional advice from a qualified nutritionist, dietitian, or medical doctor.
• If you have any medical condition, food allergy, eating disorder, or special dietary requirement, you must consult a qualified healthcare professional before relying on information provided by this service.
• We do not guarantee any specific health outcomes from using the service.

7. Acceptable use

You agree to use Señor Bistec only for its intended purpose of personal nutrition tracking and coaching. You must not:

• Use the service for any unlawful purpose or in violation of these Terms.
• Attempt to reverse-engineer, extract, or abuse the AI models or APIs used by the service.
• Use automated systems (scripts, bots) to interact with Señor Bistec, except through Telegram as intended.
• Submit content that is illegal, harmful, abusive, or infringes third-party rights.
• Create multiple accounts to abuse the free trial or referral programme.
• Resell, redistribute, or commercially exploit the service or any content generated by it.

We reserve the right to suspend or terminate your account if we reasonably determine that you are violating these Terms.

8. Limitation of liability

To the maximum extent permitted by applicable law:

• The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied.
• We do not warrant that the service will be uninterrupted, error-free, or that AI estimates will be accurate.
• Our total liability for any claims arising from or related to the service shall not exceed the total amount you have paid us in the 3 months preceding the claim.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, health-related damages, or loss of profit.

Nothing in these Terms limits liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded or limited under applicable law.

9. Intellectual property

All content, software, AI models, branding, and materials related to Señor Bistec are the intellectual property of the Provider or its licensors. You retain ownership of the content you submit (photos, messages), but grant us a limited licence to process it for the purpose of providing the service.

10. Right of withdrawal

As a consumer within the European Union, you have the right to withdraw from your subscription within 14 days of purchase without giving any reason, in accordance with Directive 2011/83/EU and its Spanish transposition.

To exercise this right, you must inform us of your decision by submitting a clear statement (for example, by email or using the model withdrawal form). The withdrawal period expires 14 days after the day of the conclusion of the contract.

If you have already used the service during the withdrawal period, you may be required to pay a proportionate amount for the service provided up to the point of withdrawal.

11. Modifications to the Terms

We may modify these Terms at any time. If we make material changes, we will provide at least 30 days’ notice via the bot or the website before the new terms take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your subscription before the new terms take effect.

12. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of Spain.

For consumers resident in the European Union, the courts of the consumer’s place of residence shall have jurisdiction in accordance with applicable EU legislation. In all other cases, the courts of Valencia (Spain) shall have exclusive jurisdiction.

Before initiating any legal proceedings, we encourage you to contact us at mrolcheg@gmail.com to attempt to resolve any dispute amicably.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
