Right of Withdrawal
1. Your right of withdrawal
As a consumer within the European Union, you have the right to withdraw from any distance contract within 14 calendar days without giving any reason, in accordance with Directive 2011/83/EU of the European Parliament and of the Council on consumer rights, and its Spanish transposition (Real Decreto Legislativo 1/2007).
The withdrawal period expires 14 days after the day of the conclusion of the contract (i.e. the date you subscribed to Señor Bistec).
2. How to exercise your right
To exercise your right of withdrawal, you must inform us of your decision to withdraw by means of an unambiguous statement. You may:
- Send the completed model withdrawal form below by email to [email protected].
- Send any other clear written statement of your decision to withdraw to the same email address.
To meet the withdrawal deadline, it is sufficient for you to send your communication regarding the exercise of your right of withdrawal before the withdrawal period has expired.
3. Effects of withdrawal
If you withdraw from the contract, we will reimburse all payments received from you without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw.
We will make the reimbursement using the same means of payment that you used for the initial transaction (Stripe), unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.
Note on services already used: If you requested that the service begin during the withdrawal period (i.e. you actively used Señor Bistec for meal tracking after subscribing), you may be required to pay an amount proportional to what has been provided until you communicated your withdrawal, in comparison with the full coverage of the contract. This is in accordance with Article 108 of Real Decreto Legislativo 1/2007.
4. Withdrawal and the free trial
The right of withdrawal applies to the paid subscription. During the 14-day free trial, you are not charged, so there is nothing to withdraw from. If you do not wish to continue after the trial, simply do not subscribe.
If you subscribe and then exercise your right of withdrawal within 14 days of subscription, the provisions of Section 3 above apply.
5. Model withdrawal form
In accordance with Annex I(B) of Directive 2011/83/EU, you may use the following model form to withdraw from the contract. Completing and submitting this form is not mandatory — any clear statement of your intention to withdraw is sufficient.
